The hearing on convicted child molester Dino Cardelli's request to shorten his 18-year prison sentence by two years was reset Friday to Sept. 5.
Humboldt County Assistant District Attorney Kelly Neel said the case is proceeding.
"Nothing else has changed," she said.
Cardelli, the former pastor of Arcata's Calvary Chapel, was sentenced to 16 years in state prison in 2011 after pleading guilty to sexually abusing and molesting his two adopted daughters. Two additional years were added after he pleaded guilty to 25 counts of violating a court order not to contact one of the girls.
Cardelli appealed the case in April 2013, arguing the additional two-year sentence should run concurrently with his 16-year sentence rather than consecutively. In a ruling last month, the 1st District Court of Appeal ordered the case be sent back to the trial court due to Cardelli never having the chance to argue for a new attorney during his appeal.
Cardelli is set to appear in court on Sept. 5 at 2 p.m.
